Planned Parenthood Drops Case Against Lubbock, Texas Over Pro-Life Law

Planned Parenthood has voluntarily dropped a lawsuit against a Texas city over its abortion sanction that was approved by voters.

  • Planned Parenthood eventually withdrew the appeal on Jan. 20 after they requested an injunction against the enforcement, but according to The Daily Citizen, the court turned their request down.
  • In his opinion, U.S. District Judge James Wesley Hendrix stated: “Because the ability to remedy a plaintiff’s injury through a favorable decision is a prerequisite to a plaintiff’s standing to sue—an ability absent here—the court dismisses the case for lack of jurisdiction.”
  • Right to Life East Texas explained, “The ordinance is structured in a manner similar to the Texas Heartbeat Act, which outlaws abortion after a fetal heartbeat is detectable but prohibits state officials from enforcing the law, instead authorizing private citizens to sue those who perform or aid or abet illegal abortions.
  • “By adopting this unique private-enforcement scheme, the city of Lubbock made its ordinance immune from pre-enforcement lawsuits because neither the city nor its officials have any role in enforcing the law, so they cannot be subjected to lawsuits that challenge the constitutionality of the ordinance.”
