Biden Keeps Trump-Era Border Policy Blocking Hundreds of Thousands of ‘Noncitizens’

Biden admin implements Trump’s Title 42 expulsion policy in response to CDC’s warning of “serious danger” at the U.S. southern border.

QUICK FACTS:
  • The U.S. southern border is being overwhelmed by surging illegal border crossings.
  • In response, the Biden administration will leave in place a Trump-era public health rule (Title 42) that has ensured the blocking of hundreds of thousands of illegal border crossings into the U.S., according to The New York Times (NYT).
  • Title 42 allows U.S. officials to send migrants back to Mexico without offering asylum or other protections in the United States, according to Reuters.
  • Border officials are calling the persistent pace of illegal migration into the country a “humanitarian crisis,” notes NYT.
  • The decision was confirmed by the Centers for Disease Control and Prevention (CDC) on Monday.
  • The CDC said that allowing illegal immigrants through the border “creates a serious danger” of further spread of the coronavirus, according to NYT.
  • The CDC renewed Title 42 on Monday, notes Reuters, “issuing an updated version of the order that called for the measure to be reevaluated every 60 days, rather than 30 days.”
THE BORDER CRISIS:
  • The number of times border officials caught migrants crossing illegally in June was the highest monthly figure since April 2000, notes NYT.
  • U.S. Border Patrol “informed the police department that on July 25, 2021 they had surpassed 1 million apprehensions in the month of June,” according to CBS DFW.
  • The National Sheriffs Association said that “up to half of undocumented immigrants are infected with the deadly disease,” notes Reuters.
WHAT BORDER OFFICIALS ARE SAYING:
  • Assistant secretary for border and immigration policy at the Department of Homeland Security (DHS) David Shahoulian said keeping the CDC’s public health order to mitigate illegal border crossings in place is “critical” given the current conditions, according to NYT.
  • The United States “is currently encountering record numbers of noncitizens, including families, at the border. These encounter rates have strained DHS operations and caused border facilities to be filled beyond their normal operating capacity, impacting the ability to employ social distancing,” said Shahoulian in an official declaration.
  • Shahoulian goes on to say that “DHS is also experiencing significantly increased rates of noncitizens testing positive for COVID-19,” so taking away Title 42 “would exacerbate overcrowding at DHS facilities and create significant public health risks.”
  • “The department lacks sufficient capacity to safely hold and process all individuals seeking to enter the United States during the global pandemic if the U.S. Government were restricted in its ability to implement the CDC order [Suspending the Right to Introduce Certain Persons from Countries where a Quarantinable Communicable Disease Exists],” he said.
  • “During this period and given the unique public health danger posed by the ongoing pandemic, implementation of the CDC Order is critical to preventing overcrowding and the spread of infection within DHS facilities,” Shahoulian concludes.

DEMOCRATS PUSH BACK AGAINST BIDEN:
  • Biden has come under intense pressure for months from his own party and supporters of liberal immigration policies to lift Title 42, reports NYT.
  • The American Civil Liberties Union (ACLU) said on Monday it would sue the Biden administration to lift Title 42.
  • Lead ACLU lawyer Lee Gelernt said, “It is now clear that there is no immediate plan to do that,” adding “The administration made repeated public statements that it just needed some time to build back the asylum system the Trump administration depleted. We gave them seven months. Time is up.”
BACKGROUND:
  • The Trump administration implemented Title 42 over a year ago.
  • The Biden admin has departed from Trump’s policy in that it has not applied to migrant children arriving alone at the southern border, notes NYT.
  • Biden stepped up enforcement at the southern border over the weekend, sending more officers.

After Attacking ‘Racist’ Voter ID Laws, NYC Gov’t Mandates Vax Pass Targeting 2/3 of Black Residents

The Big Apple introduced a proof of vaccination requirement for bars, restaurants, gyms, public entertainment and other venues on Tuesday, after months of wrangling with rights groups about whether such measures might constitute a violation of citizens’ rights and privacy.

Fox News host Sean Hannity has slammed New York City Mayor Bill de Blasio over his newly rolled out vaccine passport initiative, suggesting that vaccination figures show that it will disproportionately affect the city’s black residents.

“Anyone that wants to dine indoors, or go to a gym, or do pretty much anything inside, you’ll need to present documents proving that you’ve been vaccinated. Remember, for months now Democrats insisted that all forms of voter ID [are] ‘racist’. They called voter verification, voter ID laws ‘Jim Crow of the 21st century…But apparently identification for daily activities is Democratic approved,” Hannity said on his talk show on Tuesday night.

“Something to keep in mind: There is a New York statistic that shows only 33 percent of African Americans in New York City are vaccinated…This means that under Comrade de Blasio’s rules, that would mean 66 percent, fully two thirds of African Americans will be barred from restaurants, from concerts, from venues where you have ball games, from gyms, movie theatres, all in New York City,” the host complained.

Hannity went on to ask how the new rules would apply to those with medical exemptions. “Maybe your doctor says you shouldn’t get the shot, shouldn’t get the vaccine because of this rare condition or that rare condition. What about the Cleveland Clinic and following their science…They said if you have Covid, you don’t need any vaccine. And never mind medical privacy…never mind your doctor-patient confidentiality.”

The host said the new rules for New York City were just one example of “draconian measures” being implemented across the country, including the recently implemented vaccine mandates for government workers in New York and California, and indoor mask mandates in some cities and among the military.

“Federal officials are also calling on children as young as three years old to wear masks at all times in school. That might be task impossible,” he suggested, also recalling federal government recommendations that parents wear masks around their own children in their own homes.

Hannity suggested that the “vaccine hesitancy” expressed by some Americans that’s been criticised by the Biden administration and other senior officials is the result of all the new and contradictory protocols and regulations on masks, treatment and vaccination coming out on a daily basis.

New York-Style Rules

The Big Apple was among the first major US cities to go into lockdown last year, and mayors and officials in other major metropolitan areas have looked to measures taken by New York to decide on their own coronavirus response measures.

On Tuesday, Mayor de Blasio announced that the new proof of vaccination rules means patrons of restaurants, bars, and other venues will have to turn customers away if they don’t have a CDC vaccination card or vax app starting 16 August. Inspections and local enforcement of the rules will begin on 13 September, coinciding with the first week of school.

In his remarks introducing the measure, dubbed the “Key to NYC Pass,” de Blasio told New Yorkers that “if you want to participate in our society fully, you’ve got to get vaccinated.”

“This is a miraculous place, literally full of wonders, and if you’re vaccinated, all that’s gonna open up to you. You’ll have the key, you can open the door.” he added. De Blasio warned, however, that “if you’re unvaccinated, unfortunately, you will not be able to participate in many things.”

It’s not immediately clear why New York City is introducing the vaccination passport system at this stage. Over 71 percent of the city’s adult residents have already received either one or both shots of one of the approved US vaccines, in line with the federal government’s goal of inoculating 70 percent of Americans 18 or older by the 4 July holiday. That target was reached earlier this week.

Some residents and small business owners have expressed disdain for the new rules, expressing fears that the vaccine passport idea may put the final nail in the coffin of venues still struggling to dig out from last year’s lockdowns and the downturn in the economy.

Melissa Fleischut, president and CEO of the New York State Restaurant Association, complained that the government continues to make “things harder on our industry,” and warned that “we can’t take it much longer.”

Huge PA Election Audit Development: GOP Senator Says ‘Let the Fun Begin’

As the Arizona election audit nears its end, one Republican lawmaker is preparing to take a critical swing state down the same path.

Pennsylvania state Sen. Doug Mastriano may have just fired the first shots in a battle between the state Legislature and the counties that are refusing to cooperate with a potential audit.

In Arizona, the Republican-controlled state Senate clashed repeatedly with officials in Maricopa County before it was finally able to go forward with a forensic audit, the final results of which have yet to be released.

Mastriano, who traveled to Arizona this summer to observe the audit, took the first steps toward an audit in his own state last month, The Epoch Times reported. The lawmaker requested ballots and access to voting machines in three Pennsylvania counties: Tioga, York and Philadelphia.

The counties, which were given a July 31 deadline to comply, refused.

As far as Mastriano is concerned, that meant only one thing: It’s on.

“As soon as I get a quorum, we will have a meeting, we will vote on subpoenas, and let the fun begin,” he said last week, according to the Times.

After Mastriano made his requests in July, Pennsylvania’s acting Secretary of State Veronica Degraffenreid began issuing what may easily be described as threats to the counties concerned, warning that she would decertify any election equipment turned over to a third party.

She has since done so — Fulton County’s election systems were decertified after a third-party assessment of its machines was carried out.

Other counties were not willing to take this risk.

“We can’t be in a position where we don’t have the election machines because we have to run the next election. These are extremely expensive machines, and our position is we need to follow the direction that [Degraffenreid] has given us,” Tioga County Solicitor Christopher Gabriel said.

On July 30, Philadelphia County commissioners voted against compliance with Mastriano’s request, deferring to state and federal entities that have determined the 2020 presidential election was carried out without incident.

Democratic Commissioner Lisa Deeley asserted — somewhat ironically — that further scrutiny would place future elections at risk.

“Philadelphia County’s participation in your proposed analysis would be duplicative of extensive efforts already undertaken by the Philadelphia County Board of Elections, the Pennsylvania Department of State, state and federal courts, and your colleagues in the Pennsylvania State Senate. Participation could also impair our ability to operate fair and secure elections in Philadelphia,” she wrote in a letter to Mastriano.

The state senator has accused Democratic Gov. Tom Wolf and Degraffenreid of “trying to threaten and bully” Pennsylvania counties into refusing to cooperate with an audit.

Fulton County Commissioner Stuart Ulsh, a Republican, said the assessment in his county was conducted under strict and secure supervision, and alleged that officials from the Pennsylvania Department of State had asked him to remove the report from Fulton’s website.

“It makes you wonder what you’re trying to hide,” Ulsh said.

Pennsylvania’s executive branch fighting tooth and nail against Mastriano’s request doesn’t make the case for the integrity of the election any stronger.

As Gen. Michael Flynn noted in a recent Op-Ed for The Western Journal, Pennsylvania’s election data showed some very odd changes in voting patterns.

The 2020 election saw a significant increase in Republican voters, which is typically consistent with a subsequent Republican victory. Former President Donald Trump flipped the state in 2016, gained voters, and then lost Pennsylvania in 2020.

Maricopa County, which accounts for almost two-thirds of the votes cast in Arizona, hadn’t voted for a Democrat for president since 1948. That includes 1996, when Bob Dole became the first Republican to lose the state in nearly half a century and still took Maricopa.

Is it really so odd that lawmakers still have questions about the 2020 election? Is it really so dangerous to go looking for answers?

If Pennsylvania goes the way of Arizona, we may soon find out why so many Democrats are fighting so hard to prevent further scrutiny of a very unusual election.
