Judge in Trump Ballot Case Declines to Recuse Over Political Donation

The Colorado judge overseeing the case aiming to remove Donald Trump from the state’s 2024 ballot declined to recuse herself, according to a report from The Daily Caller.

Colorado District Judge Sarah Wallace, appointed by Governor Jered Polis (D-CO), previously donated $100 to a political action committee (PAC) created in response to the January 6 U.S. Capitol event.

“Its website proudly proclaims that the group was formed ‘shortly after Colorado Republicans refused to condemn the political extremists who stormed the United States Capitol on January 6, 2021,'” Trump attorney Scott Gessler wrote in his motion seeking Wallace’s recusal. “A contribution to the Colorado Turnout Project shows support for the view that January 6, 2021, constituted an ‘insurrection.'”

The lawsuit seeks to remove Trump from the state’s ballot under the 14th Amendment, alleging that Trump engaged in an “insurrection” on January 6, 2021.

Wallace did not recuse herself, claiming she had “no specific memory” of the political donation she made before becoming a judge.

“Prior to yesterday, I was not cognizant of this organization or its mission,” Wallace stated. “It has always been my practice, whether I was entirely successful or not, to make contributions to individuals, not PACs.”

She noted that she has “formed no opinion whether the events of Jan. 6 constituted an insurrection.”

According to data from the Federal Election Commission (FEC), Wallace also donated to Georgia Sen. Raphael Warnock’s campaign (D), Colorado senatorial candidates, and the Colorado Democratic Party.
