Trump Files to Dismiss Georgia Election Case

Donald Trump filed a motion to dismiss his election case in Fulton County, Georgia.

Trump’s legal team argued that the former president has immunity from prosecution.

“The indictment in this case charges President Trump for acts that lie at the heart of his official responsibilities as President. The indictment is barred by presidential immunity and should be dismissed with prejudice,” his lawyers wrote.

“Historical practice over 234 years confirms that the power to indict a current or former President for official acts does not exist,” they noted. “The Supreme Court’s analogous immunity doctrines—including presidential immunity from civil suit, legislative immunity, and absolute judicial immunity—confirm that the President is immune from criminal prosecution for official acts.”

Trump’s lawyers explained that matters involving his indictment “lie at the very heart of presidential responsibility.”

In August, Trump issued a not guilty plea in the Georgia indictment over allegations linked to his endeavors to overturn the 2020 election results.

The Fulton County Superior Court received a statement from Trump that read, “As evidenced by my signature below, I do hereby waive formal arraignment and enter my plea of NOT GUILTY to the Indictment in this case.”
