President Donald Trump announced that there are alternative routes his administration can take to continue his tariffs following the Supreme Court’s ruling.
Following the decision, Trump called the decision “deeply disappointing” on Truth Social. “The Supreme Court’s Ruling on TARIFFS is deeply disappointing! I am ashamed of certain Members of the Court for not having the Courage to do what is right for our Country,” he wrote. “I would like to thank and congratulate Justices Thomas, Alito, and Kavanaugh for your Strength, Wisdom, and Love of our Country, which is right now very proud of you. When you read the dissenting opinions, there is no way that anyone can argue against them.”
“The Good News is that there are methods, practices, Statutes, and other Authorities, as recognized by the entire Court and Congress, that are even stronger than the IEEPA TARIFFS, available to me as President of the United States of America,” Trump added.
National security tariffs, such as those under Section 232 and Section 301, remain in place.
President Trump declared during a press briefing that he will “sign an order to impose a 10 percent global tariff under Section 122, over and above our normal tariffs already being charged.” Section 301 investigations will also be conducted to “protect our country from unfair trading practices of other countries and companies,” he said.
President Trump’s comments to reporters come as the Supreme Court rejected Trump’s use of the International Emergency Economic Powers Act (IEEPA), a law that allows the president to “regulate importation.”
“We claim no special competence in matters of economics or foreign affairs,” Chief Justice John Roberts wrote for the Court. “We claim only, as we must, the limited role assigned to us by Article III of the Constitution. Fulfilling that role, we hold that IEEPA does not authorize the President to impose tariffs.”
