Rep. Raskin Calls for Justice Clarence Thomas to Recuse Himself From Trump Decision

Representative Jamie Raskin (D-MD) said that Supreme Court Justice Clarence Thomas should recuse himself from the decision on whether Donald Trump can be disqualified from the 2024 presidential ballot under the 14th Amendment.

Speaking to CNN’s Dana Bash, who asked if “any of the justices recuse themselves,” Raskin began describing the Supreme Court’s code of ethics.

“The Supreme Court has developed what they’re describing as a code of ethics. It’s not binding in the sense that they’re not going to anyone else. They could have gone to for example, circuit court justices, so they’re deciding for themselves, again, whether they’re in violation of their code of ethics,” he stated.

“But anybody looking at this in any kind of dispassionate, reasonable way would say, if your wife was involved in the big lie, in claiming that Donald Trump had actually won the presidential election and had been agitating for that and participating this the events leading up to January 6th, that you shouldn’t be participating.”

Bash asked, “So he should recuse himself?”

Raskin responded emphatically, “He absolutely should recuse himself. The question is, what do we do if he doesn’t recuse himself.”

Although the Colorado Supreme Court initially declared that Trump could not be on the ballot after violating the 14th Amendment’s insurrection or rebellion clause, the Secretary of State said that he would be on the ballot.

Colorado Secretary of State Jena Griswold announced in a press release that Donald Trump will be “included as a candidate on Colorado’s 2024 Presidential Primary Ballot when certification occurs on January 5, 2024, unless the U.S. Supreme Court declines to take the case or otherwise affirms the Colorado Supreme Court ruling.”

Griswold stated, “Donald Trump engaged in insurrection and was disqualified under the Constitution from the Colorado Ballot. The Colorado Supreme Court got it right. This decision is now being appealed. I urge the U.S. Supreme Court to act quickly given the upcoming presidential primary election.”
