Three attorneys general have filed a new challenge in their lawsuit against the abortion pill mifepristone.
The new filing specifically targets the FDA’s approval of a generic version of mifepristone.
“Mifepristone is sending women to the hospital with life-threatening complications, and yet drug companies continue pushing new versions of it into the market without basic medical safeguards,” said Missouri Attorney General Catherine Hanaway. “Mail-order abortion drugs are dangerous when taken without in-person care, and Missouri will not stand by while manufacturers gamble with women’s lives.”
Kansas Attorney General Kris Kobach and Idaho Attorney General Raúl Labrador joined Hanaway in the case.
“Mifepristone is a high-risk drug that the FDA continues to green-light despite its devastating effects on pregnant women and girls. Studies of the real-world use of mifepristone concluded that significant morbidity and mortality have occurred following the use of mifepristone as an abortifacient,” the filing says, adding that the generic drug is “chemically identical to Danco’s Mifeprex and GenBioPro’s generic mifepristone.” It therefore brings the same side effects, risks, and harms to pregnant women and girls as Mifeprex and GenBioPro.”
In a September letter to Evita Solutions, the FDA wrote, “We have completed the review of this [new drug application] and have concluded that adequate information has been presented to demonstrate that the drug meets the requirements for approval under the FD&C Act. We have determined your Mifepristone Tablets, 200 mg to be bioequivalent and therapeutically equivalent to the reference listed drug (RLD), Mifeprex (mifepristone) tablets, 200 mg, of Danco Laboratories, LLC.”
A statement from Evita Solutions says that the “generic mifepristone” can be used “up to 70 days from the first day of the last menstrual period.”
At the time of the drug’s approval, Senator Josh Hawley (R-MO) wrote on X, “This is shocking. FDA has just approved ANOTHER chemical abortion drug, when the evidence shows chemical abortion drugs are dangerous and even deadly for the mother. And of course 100% lethal to the child.”
