A Georgia judge dismissed two criminal charges against former President Donald Trump.
The charges surround Fani Willis’ RICO case against Trump.
According to Fulton County Judge Scott McAfee, state prosecutors cannot file the three charges because a Supreme Court decision “preempts the State’s ability to prosecute perjury and false filings in a federal district court.”
“Because Counts 14, 15, and 27 lie beyond this State’s jurisdiction and must be quashed, the Defendants’ motions to dismiss the indictment under the Supremacy Clause are granted in part,” he wrote.
Counts 15 and 27 related to Trump, Conspiracy to Commit Filing False Documents, and Filing False Documents, respectively.
While Trump was not charged with Count 15, Conspiracy to Commit Filing False Documents, others involved in the case were.
Judge McAfee dropped three other charges earlier this year.
Steve Sadow, Trump’s lead attorney on the case, said in a statement that “President Trump and his legal team in Georgia have prevailed once again. The trial court has decided that counts 15 and 27 in the indictment must be quashed/dismissed.”
