Federal Judge Orders Biden Admin to Repeal Title 42, Worsens Border Crisis

Judge Emmet Sullivan of the U.S. District Court for the District of Columbia ordered the Biden Administration to end Title 42 by December 21. Title 42 was originally designed as a health policy in the 1940s and used by President Trump to deport illegal immigrants during the COVID pandemic. Repealing Title 42 would make the border crisis worse, as there have already been 2.76 million illegal crossings in the fiscal year of 2022.

Department of Homeland Security Secretary Alejandro Mayorkas and other members of the administration continue to insist the border is “secure.” This makes one wonder whether there is literally any metric that would render it “unsecure” by Biden administration standards. The number of crossings we’re seeing at the southern border are breaking monthly and yearly records. It’s been decades since we’ve seen anything like it.

The excuse Mayorkas came up with at a House hearing on Tuesday, Nov. 15, was that an uptick in border crossings is a hemispheric phenomenon.

With the elimination of Title 42, the bad situation will almost certainly get worse. The administration says it has a “plan” to deal with the end of Title 42 and the expected surge in Venezuelan migrants heading for the U.S.-Mexican border.

Mayorkas said at a Senate Homeland Security and Governmental Affairs Committee hearing on Thursday, Nov. 17, that the plan was “building a lawful pathway for them to arrive safely and in an orderly way to the United States” alongside a “consequence regime should they not avail themselves of that lawful pathway”—whatever that means.
