An attorney for former CIA Director John Brennan said his client was subpoenaed as part of a Department of Justice (DOJ) investigation into whether former officials illegally conspired against President Trump.
Kenneth L. Wainstein, the attorney, confirmed that Brennan was asked by a federal prosecutor to testify before a grand jury in October. “On Thursday, September 10, 2026, I accepted service on behalf of Plaintiff for a subpoena to testify on October 15, 2026, before a federal grand jury sitting in Fort Pierce,” the court filing says. “The subpoena was signed by Joseph E. diGenova on September 9, 2026. The accompanying email directed me to contact Mr. diGenova with any questions regarding the subpoena.”
DiGenova resigned the same day the subpoena was delivered.
“On September 11, 2026, I along with co-counsel, participated in a conference call with Kurt Olsen and three other members of the prosecution team to discuss the grand jury subpoena served on my client,” it adds. “In that call, Mr. Olsen fielded our inquiries and indicated there are multiple ‘viable’ grand jury investigations, including a ‘far-reaching’ investigation in Fort Pierce that includes ‘issues at Mar-a-Lago and beyond’ into whether President Trump had his civil rights violated.”
Brennan filed a lawsuit against the Trump administration earlier this year, alleging the probe into him is an act of “unconstitutionally vindictive and selective prosecution.”
“President Trump has been condemning and calling for Director Brennan’s prosecution for years,” the lawsuit states. “Administration officials from the Acting Attorney General to the FBI Director and the Counselor overseeing the Brennan investigations have been publicly declaring Director Brennan a criminal, not only before securing a conviction in court but even before a full investigation and an indictment.”
