Biden Considering National Public Health Emergency Declaration if Roe v. Wade Is Overturned

  • Joe Biden and his staffers are reportedly considering declaring a public health emergency if the Supreme Court overturns Roe v. Wade. 
  • Biden’s first indication that he was willing to use his executive power to undercut laws that prevent women from ending their pregnancies came during a recent interview with comedian Jimmy Kimmel.
  • “It’s just ridiculous in my view and I don’t think the country will stand for it, but I think what we’re going to have to do, there’s some executive orders I could employ, we believe, we’re looking at that right now,” Biden said during the television interview.
  • More recent reports indicate that the president might use his powers to shield doctors from legal repercussions for treating patients in states where they are not licensed.
  • Another avenue would be allowing doctors to practice in states that ban abortions by allowing the procedures on federal sites, such as military bases.
  • Abortion law isn’t the only reason Biden has asserted he was willing to declare an emergency for political issues.
  • Biden previously threatened oil companies, saying that he was considering use of emergency declarations to force the industry to produce more gasoline. 
  • In another instance, Biden used the Defensive Production Act and suspended the tariffs on solar panels for a two-year period in an attempt to boost the solar industry. 
  • Biden also used the Defense Production Act in an attempt to fend off the shortage of infant formula.
  • A decision is expected within the next few weeks in the Supreme Court case that could overturn Roe v. Wade, revoking federally allowed access to abortion, which has been legal since 1973.
