The House advanced an edited version of Section 702 of the Foreign Intelligence Surveillance Act (FISA) on April 12.
Section 702 allows intelligence agencies to surveil foreigners without a warrant. Agencies may also hold information on Americans who have contacted the foreign individual.
The legislation was revised to be reauthorized for two years instead of five.
The chamber passed the rule in a 213-208 vote.
House members also held a vote on an amendment that would require the government to obtain a warrant before purchasing Americans’ data.
The amendment failed, however.
“Speaker Mike Johnson just inexcusably voted against the American people and his voters by casting the tie-breaking vote 212-212 to defeat a FISA 702 amendment requiring a warrant to spy on Americans,” Turning Point USA founder Charlie Kirk wrote on X. “This is how the Constitution dies. Brought to you by the House GOP.”
On Wednesday, the House of Representatives voted to block the initial FISA bill.
Former President Donald Trump publicly opposed the bill, urging lawmakers to “kill” it. His message appeared to sway enough House Republicans, as 19 of them joined 209 Democrats to defeat the legislation that would have renewed Section 702 of FISA.
“KILL FISA, IT WAS ILLEGALLY USED AGAINST ME, AND MANY OTHERS. THEY SPIED ON MY CAMPAIGN!!!” Trump posted on Truth Social before the vote.
