A Defense lawyer representing Proud Boys member Dominic Pezzola, Robert Roots, said in a court filing that “at least 40 undercover informants or agents doing surveillance among defendants on January 6.”
According to Roots, ther were 19 informants from Homeland Security Investigations (HSI), 13 from the DC Metro Police, and 8 FBI sources that the government admitted were present during Jan 6.
Roots wrote in the filing, “Pezzola recently learned that a federal agency other than FBI — the Homeland Security Investigations (HIS) unit — was handling and running undercover CHSs [Confidential Human Sources] on Jan. 6. The federal prosecutors in this case are refusing todisclose information regarding these non-FBI informants. The existence, andlikely conduct of these CHSs is almost certainly exculpatory for Pezzola.”

Roots had motioned Friday for permission to issue a subpoena for Jan. 6 rioter Ray Epps, who has been accused of being an FBI informant, though Epps and others have vehemently denied this. The attorney argued Epps “is being suspiciously protected from prosecution by the government,” and the Friday motion referenced Jan. 6 defendant William Pope‘s claims that undercover MPD officers were instigating the Jan. 6 crowd from within to storm the Capitol.
