President-elect Donald Trump filed an amicus brief to stop the Biden administration from selling off border wall materials.
The brief, filed in the Southern District of Texas, says Trump is “deeply troubled by recent reports that officials in the Biden Administration have been selling off border-wall materials at rock-bottom prices, especially during this lame-duck period.” It adds that Trump has a “paramount interest in preventing any unlawful sell-off of border wall materials that may be occurring.”
“The outgoing Biden Administration’s reported ‘fire sales’ of border-wall materials to private parties raise grave concerns about the legality of Defendants’ conduct and their compliance with this Court’s permanent injunction in this case,” the brief states. “The Court should order an immediate stop of all such sales and perform a searching examination of the Government’s conduct—by ordering formal discovery if necessary—to ensure compliance with the Constitution, the law, and the Court’s orders.”
“The Court should issue an order directing the Defendants to immediately stop any ongoing sale of border-barrier materials to private parties pending the Court’s review of Defendant’s conduct, and the Court should swiftly conduct a searching examination of the Government’s conduct, by formal discovery if necessary, to examine the Government’s compliance with the law, the Constitution, and the Court’s injunction,” the brief concludes.
Last week, The Daily Wire revealed that the Biden administration is auctioning off unused materials for the border wall. Video footage shows unused sections of the wall being carried away by trucks. A border patrol agent told the outlet that the government is taking supplies from “three stations: Nogales, Tucson, and Three Points.” The agent noted that the “goal is to move all of it off the border before Christmas.”
Texas Lt. Governor Dan Patrick declared that he “will bid on all of that wall, and we will buy it in Texas, and we will give it to Donald Trump.” He added that he has a “billion dollars in [his] pocket to do it.”
