Nevada Judge Rejects Move to Make Abortion Constitutional Right

A judge in Nevada rejected a petition from pro-abortion advocates seeking to make abortion a constitutional right in the state.

District Court Judge James Russell ruled that the proposed ballot measure is too broad.

“The Petition embraces a multitude of subjects that amount to logrolling,” he wrote, according to The Epoch Times.

“For instance, it is unclear how a vasectomy relates to infertility care or postpartum care,” he explained. “Likewise, it is unclear how postpartum care is related to abortions or birth control. Thus, it is improper to characterize these broad categories as a ‘single subject.'”

“The Legislature could not reduce ‘reproductive health’ to a single statute, let alone a single statutory chapter,” Russell added.

The judge noted that the measure would require funding, as the state would need to establish a board for abortion oversight.

Nevada’s Consitution prohibits any citizen ballot initiative demanding additional spending unless it allows for “raising the necessary revenue.”

“If no board is created … then the plain meaning of the petition would be rendered meaningless,” the judge wrote.

According to Reno ABC affiliate KOLO-TV, the judge said the initiative “clearly violated the statute with regards to the kinds of initiatives that should be presented to the public.”
