Mark Kelly Faces Military Justice

War Secretary Pete Hegseth censured Senator Mark Kelly (D-AZ) over his video directing troops not to follow what he claimed were “illegal orders” from President Trump.

“Six weeks ago, Senator Mark Kelly — and five other members of Congress — released a reckless and seditious video that was clearly intended to undermine good order and military discipline,” Hegseth wrote on X. “As a retired Navy Captain who is still receiving a military pension, Captain Kelly knows he is still accountable to military justice. And the Department of War — and the American people — expect justice.”

The Pentagon has since “initiated retirement grade determination proceedings under 10 U.S.C. § 1370(f), with reduction in his retired grade resulting in a corresponding reduction in retired pay.” Hegseth also issued a formal Letter of Censure that is a “necessary process step, and will be placed in Captain Kelly’s official and permanent military personnel file.”

“These actions are based on Captain Kelly’s public statements from June through December 2025 in which he characterized lawful military operations as illegal and counseled members of the Armed Forces to refuse lawful orders,” Hegseth added. “This conduct was seditious in nature and violated Articles 133 and 134 of the Uniform Code of Military Justice, to which Captain Kelly remains subject as a retired officer receiving pay.”

In November, the Pentagon announced that Kelly was under investigation over allegations of misconduct. “A thorough review of these allegations has been initiated to determine further actions, which may include recall to active duty for court-martial proceedings or administrative measures,” the Pentagon said in a statement on social media at the time. “This matter will be handled in compliance with military law, ensuring due process and impartiality. Further official comments will be limited, to preserve the integrity of the proceedings.”

A recent video shared by Senators Elissa Slotkin (D-MI) and Mark Kelly (D-AZ), and Reps. Chris Deluzio (D-PA), Maggie Goodlander (D-NH), Chrissy Houlahan (D-PA), and Jason Crow (D-CO) urged military members to “refuse illegal orders.”

President Trump said of the video, “It’s called SEDITIOUS BEHAVIOR AT THE HIGHEST LEVEL. Each one of these traitors to our Country should be ARRESTED AND PUT ON TRIAL. Their words cannot be allowed to stand — We won’t have a Country anymore!!! An example MUST BE SET.”
