Judicial Watch Sues DOD for Records Relating to Materials Housed at Penn Biden Center

Conservative group Judicial Watch announced that it filed a Freedom of Information Act (FOIA) lawsuit against the U.S. Department of Defense (DOD) for documents relating to a Biden staffer involved in the handling of the materials housed at the Penn Biden Center.

Judicial Watch is requesting records and communications from Kathy Chung, the Deputy Director of Protocol, Office of the Secretary of Defense, for allegedly being in contact with those at the Penn Biden Center when the documents were discovered.

In an October 2023 letter to Remus’ successor Edward Siskel, Chairman of the House Oversight Committee James Comer (R-KY) wrote, “In January 2023, President Biden’s personal attorney, Bob Bauer, released a statement that included a timeline of events that inexplicably began on November 2, 2022, with the “unexpected[] discover[y]” of Obama-Biden records at Penn Biden Center,” adding that the timeline “omitted months of communications, planning, and coordinating among multiple White House officials, Ms. Chung, Penn Biden Center employees, and President Biden’s personal attorneys to retrieve the boxes containing classified materials. The timeline also omitted multiple visits from at least five White House employees, including Dana Remus, Anthony Bernal, Ashley Williams, Annie Tomasini, and an unknown staffer.”

“There is no reasonable explanation as to why this many White House employees and lawyers were so concerned with retrieving boxes they believed only contained personal documents and materials,” Comer stated.

Judicial Watch President Tom Fitton said in a statement, “While the Biden administration was scheming to jail former President Trump over a document dispute, Biden operatives were desperately trying to cover up Biden’s own and more significant document scandal. And the cover-up continues with yet another Biden agency hiding records in violation of law.”

Not only were documents discovered at the Penn Biden Center, but classified materials also surfaced in Biden’s Delaware garage.

“My Corvette is in a locked garage, OK? So it’s not like they’re sitting out on the street,” Biden said at the time, according to the New York Post.

American Faith reported in October that Biden participated in a two-day interview with the special counsel, Robert Hur, regarding an ongoing investigation into the handling of certain classified documents from his tenure as vice president.

White House spokesperson, Ian Sams, confirmed the meeting, stating, “The President has been interviewed as part of the investigation being led by Special Counsel Robert Hur.”

 “As we have said from the beginning, the President and the White House are cooperating with this investigation, and as it has been appropriate, we have provided relevant updates publicly, being as transparent as we can consistent with protecting and preserving the integrity of the investigation,” Sams added.
