A Nevada judge dismissed criminal charges against six Republicans accused of falsely declaring President Trump to have been the winner of the state’s 2020 presidential election. According to Clark County District Judge Mary Kay Holthus, there was not enough evidence to prove the Republicans intended to deceive officials.
Holthus wrote, “[T]he Court concludes that the State failed to present sufficient evidence establishing the essential elements of the offenses,” adding, “Accordingly, the Indictment cannot stand.”
“The District Court’s decision is, once again, wrong, and we will appeal to the Nevada Supreme Court, just as we did when the court first dismissed our case against these defendants,” Attorney General Aaron Ford said, as per The Hill. “That dismissal ignored established authority making Las Vegas a proper venue and was unanimously reversed by the Nevada Supreme Court. My office will continue to work to hold these fake electors accountable for their actions which attempted to undermine our democracy and erode trust in our elections.”
In November, the Nevada Supreme Court reopened the 2020 alternative electors case after President Trump pardoned those involved.
In a 6-0 move, the Nevada Supreme Court revived the case, overruling a lower court’s decision.
“We conclude that venue was properly laid in Clark County because the offenses charged were not complete upon mailing but rather necessarily involved the receipt of the certificates at the location to which they were mailed,” Justice Lidia Stiglich wrote for the court. “Respondents do not dispute that the certificates were delivered to a recipient in Clark County. The district court erred in concluding that the alleged crimes were complete upon mailing from Douglas County. We therefore reverse and remand.”
