A federal judge has blocked Joe Biden’s attempt at forcing Texas hospitals into performing abortions beyond just life-saving situations.

- Texas Attorney General Paxton filed a motion requesting a federal court block the President from misusing a federal law to have doctors in Texas to perform abortions beyond medically necessary procedures that save the woman’s life, Life News reported.
- “While the Biden Administration continues to make up rules that are unconstitutional, I will keep holding them accountable,” said Attorney General Paxton. “I will not allow the Biden Administration to threaten doctors and hospitals with this unlawful mandate and put millions of Texans’ access to healthcare on the line.”
- United States District Judge James Wesley Hendrix agreed with Paxton, saying the U.S. Department of Health and Human Services’ was unauthorized and went above the federal law.
- Judge Hendrix explained that Biden’s guidance “discards the requirement to consider the welfare of unborn children when determining how to stabilize a pregnant woman.”

The Mandate “has the effect of requiring doctors and hospitals to choose between performing abortions in violation of State law or caring for women as they always have while incurring fines and the loss of federal funding,” Paxton said.
BACKGROUND:
- Earlier this month, President Biden signed the executive order directing the secretary of Health and Human Services to consider actions to help patients travel outside their states for abortions using funds from Medicaid.
- Using a provision from the Emergency Medical Treatment and Active Labor Act (EMTALA), Biden’s order would require Texas hospitals and doctors to perform abortions as a condition of receiving such funding.
- Paxton claims this order would allow Biden to misuse the federal law designed to protect unborn children from forced abortions.
