Documents filed with the court on Tuesday show that Hunter Biden has retracted his request for a new gun trial.
Three federal criminal firearms charges against the first son resulted in his conviction in June.
In their request, Biden and his legal team argued that District Judge Maryellen Noreika of the District of Delaware lacked the power to oversee the trial due to an ongoing appeal before a higher court.
CNN said that Biden’s attorneys admitted they misinterpreted the circumstances in the updated motion, which was submitted on Tuesday.
He was found guilty by a jury last month of lying on a federal background check form claiming he wasn’t using drugs when he bought a gun in 2018. Biden continues to ask higher courts to overturn the guilty verdicts.
