GOP State Official Investigating if Trump Is Constitutionally Disqualified From Ballot

New Hampshire Secretary of State David Scanlan (R) is said to be investigating if Donald Trump is disqualified from running for the presidency as per terms in the Constitution.

Some legal counsel argue that Trump is unable to run because he violated Section 3 of the 14th Amendment.

That section of the 14th Amendment prohibits anyone from running for office if they have “engaged in insurrection or rebellion.”

Trump has not been officially charged with insurrection or rebellion.

“Not being a lawyer and not wanting to make a decision in a vacuum, I will be soliciting some legal opinions on what is appropriate or not before I make any decision,” Scanlan told The Boston Globe.

“I have some in-house staff attorneys that are election experts,” he noted. “I will be asking the attorney general’s office for their input. And ultimately whatever is decided is probably going to require some judicial input.”

How can Trump be disqualified under the 14th Amendment when he has not been officially charged with insurrection, rebellion, sedition, or even incitement?
