Erika Kirk Fights Back Against Court Delays

Charlie Kirk’s widow, Erika Kirk, is seeking a speedy trial in response to delays from the legal team representing her husband’s accused assassin, Tyler Robinson.

Kirk’s attorney, Jeffrey Neiman, wrote in a court filing that the Constitution “does not guarantee them the right to cause undue delay in the criminal justice process. The Defendant in this case is entitled to a fair trial, and he must be given one, but he is not entitled to cause undue delay to the criminal justice process.”

The Utah Code “affords victims of a crime ‘the right to a speedy disposition of the charges free from unwarranted delay caused by or at the behest of the defendant … and to prompt and final conclusion of the case after the disposition or conviction and sentence, including prompt and final conclusion of all collateral attacks on dispositions or criminal judgments,'” he wrote.

Neiman added that while the court must ensure that the Defendant has a fair trial, it “must also do so while balancing Mrs. Kirk’s right to a speedy trial and therefore this Notice invokes Mrs. Kirk’s rights under applicable Utah Code.”

Robinson made his first in-person court appearance in December, nearly three months after Kirk’s assassination.

Meanwhile, Robinson’s defense attorneys are seeking to disqualify prosecutors in the case, alleging a conflict of interest over a deputy county attorney’s child attending the campus event during Kirk’s assassination, FOX 13 reports. The relationship “raises serious concerns about past and future prosecutorial decision-making in this case,” attorneys argued, claiming that the “rush” to seek the death penalty exemplifies “strong emotional reactions.”
