Elderly Victim Sues San Fran. DA For Allowing Attackers Free

A Vietnamese-American elderly man is now suing the San Francisco District Attorney after being beaten with a bat while the attackers have been let off without jail time.

  • The 69-year-old victim Anh Le has asked the court to hold DA Chesa Boudin responsible for lessening the multiple felony charges against two suspects who attacked Le in November 2019, The Police Tribune reported.
  • The civil rights lawsuit has been filed by attorneys from the Alliance of Asian American Justice who are seeking to hold Boudin accountable for failing to uphold Marsy’s Law, a bill intended to give victims a voice regarding their attackers’ release, KNTV said.
  • Le was suddenly and aggressively attacked in front of a supermarket in Chinatown in what was described as a racially-motivated attack.
  • “I was suddenly and violently attacked by the adult male and his adolescent son brutally attacked me with a long baseball bat,” Le said.

BACKGROUND:
  • In November of 2019, the two suspects were initially charged with multiple felonies, including elder abuse and terror attacks.
  • However, over the course of several months Boudin’s office lessened the charges down to a single count of misdemeanor assault, without informing Le.
  • Le later told reporters he was “cast aside, ignored and re-victimized by the institutions,” and by doing so violated his “rights as a victim.”
  • Statistics recently released by the San Francisco Police Department, hate crimes against Asians increased by 567 percent between 2021 and 2021, KPIX reported.
