DOJ Threatens to Sue Texas Over Border Security Law

The Department of Justice has threatened to sue Texas if Governor Greg Abbott (R) enforces a new law allowing authorities to arrest illegal immigrants.

Principal Deputy Assistant Attorney General Brian M. Boynton wrote a letter to Abbott, saying that “the United States will pursue all appropriate legal remedies to ensure that Texas does not interfere with the functions of the federal government.”

Boynton noted that “the Department of Justice intends to bring a lawsuit to enforce the supremacy of federal law and to enjoin the operation of S.B.4.”

“S.B.4 therefore intrudes into a field that is occupied by the federal government and is pre-empted,” the official wrote. “Indeed, the Supreme Court has confirmed that ‘the removal process’ must be ‘entrusted to the discretion of the Federal Government’ because a ‘decision on removability’ touches ‘on foreign relations and must be made with one voice,’” the letter stated.

Abbott responded to the letter on X, writing, “The Biden Admin. not only refuses to enforce current U.S. immigration laws, they now want to stop Texas from enforcing laws against illegal immigration.”

“I’ve never seen such hostility to the rule of law in America,” the governor added. “Biden is destroying America. Texas is trying to save it.”

To combat the illegal immigration crisis, Abbott has flown illegal immigrants to sanctuary cities.

The first flight of 120 migrants headed to Chicago, Illinois.

Abbott has also bused thousands of migrants.

At the beginning of December, Abbott announced his plans to send 12,500 migrants to Washington, D.C., 25,000 to New York City, 20,000 to Chicago, 3,200 to Philadelphia, 7,400 to Denver, and 1,100 to Los Angeles.
