Court Order Compels Biden Admin to Finish Border Wall

Missouri Attorney General Andrew Bailey obtained a court order that forces the Biden administration to finish the border wall using congressionally appropriated funds.

“The Biden Administration has failed to abide by the law to finish the construction of a wall along the southwest border,” Bailey said. “Joe Biden refuses to carry out his constitutionally mandated responsibilities, so we took him to court to force him to do his job. This is a huge step forward in the fight to secure our border at a key moment in our nation’s history.”

During fiscal year 2020, Congress allocated $1.4 billion for the construction of southern border barriers. The funds were explicitly designed for the “construction of barrier systems along the southwest border,” the law read.

The Biden administration did not abide by the law, instead saying it did “not agree with the building of the wall,” according to Bailey’s office.

Missouri and Texas then filed a lawsuit against the Biden admin.

According to the court order, “Whether the Executive Branch must adhere to federal laws is not, as a general matter, an area traditionally left to its discretion.”

In a statement on X, Bailey wrote, “The rest of President Trump’s border wall is going up because of this lawsuit.”

Bailey has also filed a lawsuit against the Biden administration over its illegal immigrant flights.

The lawsuit pertains to the administration’s failure to “fulfill a Freedom of Information Act (FOIA) request asking for documents and communications regarding the transportation of illegal immigrants into Missouri,” the attorney general’s office said.

“The Missouri Attorney General’s Office has reason to believe the Biden Administration is deliberately flying illegal aliens from the border to the interior of the country and has sought to gain public records on behalf of Missouri citizens but has been met with federal interference,” the lawsuit reads. “Instead of promptly providing the AGO with the requested documents, the Department of Homeland Security (DHS) has belatedly responded with a denial of this request based on a clearly erroneous reading of the AGO’s FOIA request.”

“This game of hide and seek’ violates the spirit and the letter of FOIA, which states that an agency shall withhold information only when the agency ‘reasonably foresees that disclosure would harm an interest protected by an exemption’ or if ‘disclosure is prohibited by law,’” the lawsuit alleges.

“Hey @KamalaHarris @JoeBiden,” Bailey wrote on X. “It is a felony in the State of Missouri to knowingly transport an illegal alien. See you in court.”
