The Department of Homeland Security (DHS) recently announced a new rule that officially eliminates a loophole in the student visa program allowing foreign students to remain in the United States. The new rule integrates a fixed period of time rather than relying upon the “duration of status” loophole, joining other visa programs in doing so.
“For nearly half a century, the outdated ‘duration of status’ system has compromised national security and created an environment ripe for immigration fraud,” DHS Secretary Markwayne Mullin said in a statement. “For decades, foreign students have been admitted into the U.S. indefinitely, allowing thousands to abuse our immigration system by perpetually enrolling in courses to avoid having to leave the U.S. By implementing clear, finite limits on these visas, the United States is reclaiming its ability to properly screen, vet, and monitor individuals within our borders. This final rule ensures that foreign students remain focused on their primary purpose: completing their studies and returning home.”
The rule goes into effect on September 15.
Lawmakers have urged the Trump administration to take action against student visas, largely those issued to Chinese students. Last month, Rep. Anna Paulina Luna (R-FL) urged the State Department to pull F-1 and J-1 visas issued to Chinese students.
“I write today to urge the immediate suspension and cancellation of all F-1 and J-1 student visas held by Chinese nationals currently studying at institutions of higher education across the United States, considering recently declassified intelligence detailing the Chinese Communist Party’s efforts to interfere in American elections,” she wrote in a letter to Secretary of State Marco Rubio.
